1. Purpose

This policy sets out the terms for cancelling unit bookings and refunding payments made by prospective buyers of residential units at Capital Athena. It follows industry practice and the provisions of the Real Estate (Regulation and Development) Act,2016 (RERA).

2. Booking Amount and Application Fees

• The booking amount reserves a specific unit and is adjustable against the total consideration value.
• Application fees (where applicable) are non‑refundable and cover buyer onboarding and document processing.

3. Cancellation by the Allottee (Customer)

a) Before Builder Buyer Agreement (BBA) execution

• Submit a written cancellation request with proof of payment and ID.
• Administrative deduction: ₹25,000–₹50,000 or10% of the booking amount, whichever is higher.
• Any balance is refunded within 60 business days of approval.

b) After Builder Buyer Agreement execution

• Cancellation follows the specific terms in the signed BBA.
• Normally no refund is due because the unit is deemed sold and registered under RERA.
• Exceptional cases may be reviewed individually and may carry additional deductions.

4. Cancellation by Capital Group

If Capital Group must cancel a booking due to project non‑approval, over‑booking, or regulatory restrictions, the entire booking amount will be refunded in full without deductions or interest.

5. Refund Timeline & Mode

• Refunds start only after a written cancellation request with supporting documents (booking receipt, ID proof, bank details) is received.
• All refunds are processed via NEFT/RTGS to the original bank account within 60 business days of cancellation approval.

6. Non‑Refundable Charges

• Stamp Duty & Registration charges
• Legal / Documentation charges
• Government taxes (GST, Cess, etc.)
• Brokerage / Channel‑partner fees already disbursed
• Application or processing fees

7. Compliance with RERA

Capital Athena is registered with Uttar Pradesh RERA (Registration No.: UPRERAPRJ6377). All cancellations and refunds strictly follow the U.P. RERA guidelines.

8. Dispute Resolution

Disputes should first be addressed in writing to info@capitalathena.com. If unresolved, jurisdiction lies with the competent courts of Gautam Buddha Nagar, Uttar Pradesh, or as otherwise directed by RERA.
